    1. Introduction

    These Terms and Conditions ("Terms") govern your use of the Affinity Media website and digital out-of-home (DOOH) advertising services. By accessing our website or booking advertising space, you agree to be bound by these Terms. If you do not agree, please do not use our services.

    2. Definitions

    • "Affinity Media" refers to the operator of the digital advertising screens and this platform.
    • "Advertiser" refers to any individual or business booking advertising space through our platform.
    • "Booking" refers to the reservation of screen time at one or more of our digital billboard locations.
    • "Content" refers to any media, images, videos, or creative assets submitted by the Advertiser for display.

    3. Account Registration

    To book advertising space, you must create an account and complete your advertiser profile with accurate company details, contact information, and billing address. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

    4. Booking & Payment

    • Advance Payment: All bookings require payment in full in advance. A pro-forma invoice will be generated at the time of booking. Your advertisement will not go live until payment has been received and confirmed.
    • Pricing: Prices are determined by the applicable rate card for the selected screen location and slot type. Rates are quoted in GBP (£) and are exclusive of VAT unless stated otherwise.
    • Minimum Booking: Each rate card specifies a minimum booking period. Bookings below the minimum duration will not be accepted.
    • Payment Methods: Payment can be made via bank transfer to the details provided on your invoice. Additional payment methods may be made available in due course.
    • Confirmation: Bookings are confirmed only upon receipt and verification of payment by Affinity Media.

    5. Cancellation & Refunds

    Cancellations made more than 14 days before the scheduled start date will receive a full refund. Cancellations made between 7 and 14 days before the start date will receive a 50% refund. Cancellations made less than 7 days before the start date are non-refundable. Affinity Media reserves the right to cancel or reschedule bookings due to unforeseen circumstances, in which case a full refund or rescheduled slot will be offered.

    6. Content Guidelines

    All advertising content must comply with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code) and the Advertising Standards Authority (ASA) guidelines. Content must not be misleading, offensive, discriminatory, or promote illegal activities. Affinity Media reserves the right to reject or remove any content that does not meet these standards, without refund.

    7. Media Specifications

    Advertisers are responsible for providing content that meets the required technical specifications for the booked screen, including resolution, file format, and file size. Affinity Media is not responsible for poor display quality resulting from content that does not meet specifications.

    8. Intellectual Property

    The Advertiser warrants that they own or have obtained all necessary rights, licences, and permissions for the content submitted. The Advertiser indemnifies Affinity Media against any claims arising from intellectual property infringement related to their content.

    9. Design Studio & AI-Generated Video Content

    Where you use our Design Studio or any AI-powered media generation tools provided by Affinity Media to create video, image, or other creative assets ("Generated Content"), the following terms apply:

    • Ownership: All right, title, and interest in and to the Generated Content, including all intellectual property rights, are and shall remain the exclusive property of Affinity Media.
    • Licence to Advertiser: Subject to full payment of any applicable fees and continued compliance with these Terms, Affinity Media grants the Advertiser a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, distribute, publicly display, and adapt the Generated Content in any medium and for any purpose, including commercial use, both on and off our digital screens.
    • Scope: The licence permits use of the Generated Content in any circumstance the Advertiser sees fit, including across third-party platforms, social media, print, broadcast, and other advertising channels.
    • Reservation of Rights: Affinity Media reserves the right to reuse, repurpose, and showcase Generated Content for portfolio, marketing, training, and demonstration purposes, unless otherwise agreed in writing.
    • Third-Party Assets: Any logos, trademarks, photography, or other materials supplied by the Advertiser and incorporated into the Generated Content remain the property of the Advertiser or their respective owners.

    9a. AI System Transparency (EU AI Act)

    In accordance with Article 50 of Regulation (EU) 2024/1689 (the EU AI Act), we disclose the following about our use of AI systems:

    • You are interacting with an AI system when you use our Design Studio, which uses AI-powered tools to generate video, image, or other creative assets ("Generated Content") on your behalf.
    • Where our third-party AI providers support machine-readable marking of AI-generated content, we rely on that marking to help meet our disclosure obligations under Article 50(2). Generated Content is created based on your instructions and supplied assets; you are responsible for ensuring any final advertising content you display, whether AI-generated or not, complies with Section 6 (Content Guidelines) and all applicable advertising standards.
    • We do not use AI systems on this Site to create deepfakes of real, identifiable people without their consent.

    10. Liability

    Affinity Media shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim shall not exceed the amount paid by the Advertiser for the specific booking in question. Affinity Media does not guarantee uninterrupted display due to potential technical issues, power outages, or force majeure events.

    11. Data Protection

    We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Account information is used solely for the purpose of providing our advertising services, generating invoices, and communicating about your bookings.     12. Governing Law

    These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

    13. Changes to Terms

    Affinity Media reserves the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify registered users of material changes.
